CLARITY Missed Its Window: What Happened, and What's Left for Tomorrow
The tension we've tracked all week finally resolved just not favorably. Under Senate procedure, Majority Leader John Thune needed to file a cloture motion by Wednesday to set up a Friday vote before recess. He filed cloture that day, but for three other items: the Protect College Sports Act, a continuing-resolution funding vehicle, and Todd Blanche's nomination for Attorney General. CLARITY was absent. Thursday's schedule showed no filing either, effectively closing the pre-recess window.
Prediction markets moved fast once the pattern became clear. Polymarket's odds for 2026 passage fell from 53% on July 21 to 34%, and now sit at just 17%. Kalshi's separate contract, tracking whether the bill takes effect before July 1, 2027, dropped to 41% still meaningful, but reflecting a clear shift toward "later than 2026" as the base case.
Thune has pushed back on the idea that the bill is abandoned, describing the delay as "sequencing" rather than a decision to shelve it, and noted the Senate still intends to bring market structure legislation to a vote at some point. Senator Lummis continues to advocate for action before the recess. But the substantive disputes that have stalled the bill for weeks ethics restrictions on officials' crypto holdings, stablecoin reward provisions, and illicit-finance safeguards remain unresolved, and Senate leadership has chosen to prioritize other pending business instead.
For the market, the practical takeaway is straightforward: CLARITY is no longer a near-term catalyst. That leaves tomorrow's NFP report as the week's sole remaining major event, and it now carries the full weight of the week's macro uncertainty on its own no longer sharing the spotlight with a live regulatory vote.#CLARITYVoteMath
