⚖️ The Coldcard theft case would be fascinating to see tested in court.
The ethical question seems straightforward: if someone exploits weak entropy to access another person's Bitcoin, most people would consider it theft.
But the legal argument is more interesting.
Could a thief claim they simply "found" accessible Bitcoin because the keys were generated with a flaw? That seems unlikely.
A court would probably compare it to real-world situations:
🔒 Picking a lock to enter someone's house
💰 Finding valuable property that clearly belongs to someone else
The fact that access was possible doesn't automatically create ownership.
Courts generally look at intent, reasonableness, and good faith—making a legitimate ownership claim difficult for an attacker.
That said, a high-profile case with expensive legal teams could create some fascinating arguments around digital property, private keys, and responsibility in self-custody.
Crypto law is still being written in real time.
