Dette er den første formelle kryptoregelgivningen siden Paul Atkins tiltrådte som SEC-leder, og det er kun tre arbeidsdager fra kunngjøring til møte. Alle tre kommissærene er republikanere, og det forventes at dette trinnet blir godkjent. Men det må presiseres: fredagens avstemning handler om "om forslaget skal offentliggjøres for offentlig høring", ikke den endelige regelen. Tre kontroversielle punkter er fortsatt uløste: detaljer om anti-hvitvaskings- og håndhevelsesbestemmelser, reguleringsansvar for stabilmyntavkastning, og etiske regler for presidentens kryptoeiendeler. Elizabeth Warrens holdning representerer demokratisk opposisjon; hun sier at denne versjonen av loven "er skrevet av kryptobransjen, for kryptobransjen". Avstemningen krever 60 stemmer. Republikanerne har 53 seter, så minst 7 demokrater må krysse partilinjen. TD Cowen-analytiker Jaret Seiberg ga 75 % sjanse for at det mislykkes i en rapport 10. august. Oddsene for at CLARITY Act blir signert til lov i år på Polymarket har falt fra 82 % i februar til 21 %, med over 5,5 millioner dollar satset på dette utfallet. Logikken i sikker havn er at verdipapiregenskapene kan avta i takt med prosjektets desentraliseringsgrad. To parallelle spor Washington har nå to parallelle spor for kryptoregulering. CLARITY Act følger lovgivningssporet. Dens styrke er høyeste autoritet (lov over administrative regler), bredest dekning (definerer både SEC og CFTC jurisdiksjon), og størst varighet. Men den krever 60 stemmer, tverrpolitisk støtte, løsning av tre kontroversielle punkter, og selv om prosedyreavstemningen 15. september går gjennom, følger debatt, endringsforslag og endelig avstemning. Hvis CLARITY Act til slutt vedtas, vil den erstatte Regulation Crypto; hvis CLARITY mislykkes i Kongressen, er Regulation Crypto det beste bransjen kan få. The expected cloture vote on the motion to proceed typically requires 60 votes. If it advances, debate, amendments and a final Senate vote would follow. Senate changes could send it back to the House. Outstanding discussions include ethics provisions, stablecoin rewards, DeFi and developer protections, and investor safeguards. Meanwhile, the SEC will hold an open meeting Aug 14 to consider whether to propose Regulation Crypto Assets, a tailored offering regime for certain investment contracts involving crypto assets. The key word is "propose." Any release would still go through public comment and another Commission vote before becoming final. SEC Chair Paul Atkins previously floated three possible components with illustrative thresholds: · A startup exemption potentially lasting up to four years, with up to $5M in fundraising · A broader exemption potentially allowing up to $75M over 12 months, with tailored disclosures · A safe harbor clarifying when a crypto asset is no longer tied to an investment contract The actual proposal may differ. The SEC item is also narrower than full market-structure reform.
